RIAA, where up is down

Not long after RIAA Prez Cary Sherman's inane answers in a CNET interview, RIAA CEO Mitch Bainwol continues the fantasy with the USA Today article "RIAA chief says illegal song-sharing 'contained'".
Bainwol claims that "file-trading is flat". But the numbers are far from flat. Research firm Big Champagne measures the number of average P2P users online at any one time. There has been continued growth in P2P users. There were 8.7 million users in May 2005 and 9.7 million in May 2006, an increase of 12% in a year.

That’s an optimistic view from an industry that saw its numbers slide to near oblivion after the launch of the original Napster in 1999. CD sales fell as much as 30%, and the RIAA pressed Congress and the courts for relief against what it said was rampant piracy.

In particular, we appreciate the Administrations recommendation that Congress enact a performance right which would finally close a longstanding and unfair loophole in copyright law that denies compensation to artists and record labels when their music is played over terrestrial radio. The proposal to make illicit streaming a felony is also appropriate and overdue.
